Herding Agreement
AGREEMENT TO HOLD HARMLESS, WAIVER AND ASSUMPTION OR RISK: In consideration for participation in an event sanctioned by the American Herding Breed Association (AHBA), I agree to assume all responsibility for any claim, loss or damage, of whatever kind or nature, whether to person or property, which may be caused at or near this event, either directly or indirectly, by me or the dog or dogs I have entered in or brought to this event. I further agree that I will hold the AHBA, SCA, their officers, directors, agents and members, and/or Sug Fridley & Bridget Fridley & Reality Canine Center, harmless and defend them from any and all liability for any injury, claim, damage or loss, of whatever kind or nature, whether to person or property, caused at or near this event, whether directly or indirectly, by me or any dog I have entered in or brought to this event. I agree to indemnify the AHBA, SCA, their officers, directors, agents and members, and/or Sug Fridley & Bridget Fridley & Reality Canine Center, for any loss, cost or expense including attorneys fees and costs, to which they might be subject as a result of any claim, suit, loss or damage caused in any way by any act or negligence on my part or on the part of any dog or dogs I have entered in or brought to this event. I acknowledge that while the AHBA may provide sanctioning for this event with regard to the issuing of titles, it does not have and does not exercise control over the conduct of the event or those present. I certify and represent that the dog or dogs I have entered in or brought to this event is/are not a hazard to other dogs, other animals, or to people. I understand that Reality Canine Center is not responsible for total or partial acts, occurrences, or elements of nature that can scare an animal, cause it to bite, or react in some other unsafe way. Some examples include: thunder, lightening, rain, wind, water, and wild and other domestic animals insects, or reptiles which may walk, run, fly near, bite sting, or otherwise threaten or scare an animal or person, irregular footing on out-of-door groomed or wild land which is subject to constant changes in conditions according to weather, temperature, and natural and man-made changes in landscape. I understand that the premises upon which this activity will take place may contain tripping or falling hazards, and I assume responsibility for examining the premises to ensure that they are acceptable. By participating in the activity, I acknowledge that I have performed such an examination and found the premises to be in safe condition. I agree that should emergency medical treatment be required, I and/or my own accident/medical insurance company will pay for all such incurred expenses. I assume full responsibility for any and all damages that may occur to any livestock used during my participation in this activity. I agree to pay $250.00 per ewe of any animal killed, seriously injured, or the veterinarian bill if so required.
